Hereinafter referred to as “Flower Carpet”, “the Seller”, “we”, “us” or “our”.
These Terms and Conditions govern the online sale of clothing, accessories, souvenirs and other Flower Carpet or Flower Time merchandise through the official Flower Carpet e-shop.
They do not govern the sale of tickets or access to Flower Carpet events when those tickets are sold through a separate website or ticketing partner.
A “Consumer” is a natural person acting for purposes outside their trade, business, craft or professional activity.
By placing an order, the Customer confirms that they have read and accepted these Terms and Conditions, the Privacy Policy, the Returns and Refunds Policy and the Delivery Information.
Nothing in these Terms and Conditions limits the mandatory rights granted to Consumers under Belgian or European consumer law.
The essential characteristics of each product are presented on the relevant product page.
We make every reasonable effort to ensure that product descriptions, photographs, colours, sizes and prices are accurate.
However, colours may vary slightly depending on screen settings, lighting conditions and production batches. Minor differences that do not affect the product’s essential characteristics do not constitute a lack of conformity.
Customers purchasing clothing are responsible for consulting the available product and size information before placing their order.
Products are offered subject to availability. Adding a product to the basket does not reserve it.
If a product becomes unavailable after an order has been placed, we will inform the Customer as soon as reasonably possible and offer:
Before confirming the order, the Customer can review the selected products, quantities, delivery information, prices and applicable charges.
The Customer is responsible for providing complete and accurate billing, contact and delivery information.
By clicking the final button indicating an obligation to pay, the Customer places a binding order.
The order is considered accepted once payment has been authorised and an order confirmation has been sent by email.
We may refuse or cancel an order in the event of payment refusal, suspected fraud or misuse, clearly incorrect or incomplete customer information, an obvious pricing or technical error, product unavailability, or another legitimate reason preventing fulfilment of the order.
If payment has already been received for a cancelled order, the relevant amount will be reimbursed.
All prices are expressed in euros.
Prices displayed on the product and shop pages include the applicable VAT. During the basket and checkout process, the price excluding VAT, the applicable VAT and the final price including VAT may be shown separately.
Delivery charges are not included in the product price unless expressly indicated. They are displayed before the Customer confirms the order.
The total amount shown before payment includes the price of the products, applicable VAT, delivery charges and any valid reductions or promotional discounts.
We may change our prices at any time. The price applicable to an order is the price displayed when the Customer confirms the order, except in the event of an obvious pricing or technical error.
The payment methods currently accepted are displayed during checkout.
Payments are processed securely by the payment service provider connected to the Flower Carpet e-shop. The order will only be prepared after payment has been authorised.
Flower Carpet does not store the Customer’s complete payment card details.
If payment is refused, interrupted or cannot be confirmed, the order may remain pending or be cancelled.
Orders are currently delivered within Belgium only.
The standard delivery charge is currently €6.05, unless another amount is displayed during checkout.
Orders with an eligible product value of at least €75 qualify for free standard delivery within Belgium, as calculated during checkout.
Orders are normally delivered within 10 to 15 business days following payment confirmation. These delivery times are estimates. Delays may occur during busy periods, public holidays or circumstances outside our reasonable control.
Flower Carpet remains responsible for loss or damage during transport until the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the parcel.

A Consumer purchasing goods through the e-shop has the right to withdraw from the purchase without providing a reason.
The Consumer must notify Flower Carpet of their decision within 14 calendar days, starting on the day following the date on which the Consumer, or a third party designated by them, takes physical possession of the goods.
For a single order delivered in several parcels, the period starts on the day following receipt of the final parcel or product.
The Consumer may exercise this right by sending a clear statement to richard.poncin@flowercarpet.be. The Consumer may use the model withdrawal form included in the Returns and Refunds Policy, but this is not mandatory.
After notifying Flower Carpet, the Consumer must return the products within a further period of 14 calendar days.
The direct cost of returning an unwanted product is borne by the Customer.
Flower Carpet will bear or reimburse reasonable return costs when the product is defective, arrived damaged, is incorrect or does not correspond to the order.
The Customer may inspect and try on clothing as would reasonably be possible in a physical shop.
The Customer may be held responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics and fit of the product.
Products should therefore not be worn beyond a reasonable fitting, washed, altered, stained, damaged or used unnecessarily.
Where reasonably possible, products should be returned with their labels, accessories and original packaging. The absence of the original packaging does not automatically remove the statutory right of withdrawal.
The statutory right of withdrawal may not apply to products made to the Customer’s specifications, clearly personalised products, sealed products that are not suitable for return for health or hygiene reasons once unsealed, or other goods covered by a legal exception.
Standard clothing and non-personalised merchandise are not excluded from the right of withdrawal merely because they were purchased during a sale or promotion.
When the right of withdrawal is validly exercised, Flower Carpet will reimburse the payments concerned.
For the withdrawal of an entire order, the reimbursement includes the cost of the least expensive standard delivery method offered, where required by law. Additional delivery costs resulting from the Customer’s choice of a more expensive delivery method are not refundable.
For a partial return, the original delivery charge will only be reimbursed to the extent required by applicable law.
The reimbursement will be made using the same payment method as the original transaction, unless expressly agreed otherwise.
Flower Carpet will reimburse the Customer without undue delay and no later than 14 days after being informed of the withdrawal.
Flower Carpet may withhold the reimbursement until the returned products have been received or the Customer provides proof that the products have been returned, whichever occurs first.
Consumers benefit from the Belgian legal guarantee for consumer goods.
For new products, the legal guarantee applies to a lack of conformity identified within two years following delivery.
Where a justified lack of conformity exists, the Consumer may first request the repair or replacement of the product, unless the chosen solution is impossible or disproportionate.
Where repair or replacement is impossible, disproportionate or cannot be completed within a reasonable period, the Consumer may be entitled to an appropriate price reduction or reimbursement in accordance with the applicable law.
The legal guarantee applies independently of the 14-day right of withdrawal.
The Customer should contact Flower Carpet as soon as possible if a product arrives damaged, has a manufacturing defect, is missing or does not correspond to the order.
The Customer should provide their order number, a description of the issue and photographs where reasonably possible.
A defective or incorrect product should not be returned before practical return instructions have been communicated. This does not limit the Customer’s statutory rights.
The texts, artwork, designs, logos, photographs, illustrations, graphics and product visuals displayed on the e-shop are protected by intellectual property rights.
They may not be reproduced, modified, distributed, published or used commercially without prior written authorisation.
Purchasing a product does not transfer any intellectual property rights to the Customer.
Personal data are processed in accordance with the Flower Carpet Privacy Policy.
Data required to process an order may be shared with service providers involved in payment, delivery, hosting, invoicing, accounting, security and operation of the e-shop.
Flower Carpet is responsible for fulfilling its legal and contractual obligations.
Flower Carpet is not liable for a delay or failure caused by circumstances genuinely outside its reasonable control, such as major transport disruption, natural disasters, public authority measures, telecommunications failures or other recognised cases of force majeure.
This clause does not limit mandatory consumer rights, the legal guarantee or Flower Carpet’s responsibility for the products until delivery.

The parties will first attempt to resolve the matter amicably.

These Terms and Conditions are governed by Belgian law.
Consumers residing in another European country continue to benefit from any mandatory consumer protections applicable under the relevant rules.
Any dispute that cannot be resolved amicably will be submitted to the courts competent under the applicable law.
Flower Carpet may update these Terms and Conditions when necessary.
The version applicable to an order is the version available and accepted when the order is placed.
For now, our shelves are empty.
